Please read these terms of service (“terms”, “terms of service”) carefully before using the www.myattandco.com website (the “service”) operated by Mary Myatt Learning Ltd T/A Myatt & Co (“Us”, “we”, “our”).
1. Our Website
1.1 Use of our website by individuals, businesses, organisations and its employees, (“You”) and any service contained within are subject to the conditions stated below. Every time you visit this website, use it services and/or make a purchase, you accept the following conditions..
2. Customer Use
2.1 You should always check the contact information you provide is correct before creating a customer account or proceeding to payment.
2.2 Our website is only intended for the use by adults, as defined as those aged 18 or over and who have sufficient capacity to enter into a binding agreement.
2.3 If you are an owner of an account on this website, you are solely responsible for maintaining the confidentiality of your private user details (username, password and any payment details). You are at all times responsible for all activities that occur under your account or password and/or payment details. If you are aware or suspect that your customer account, username or password or other details have become known to a third party, you should inform us immediately.
2.4 As part of the registration process you will need to create an account, including a username and password. It is your responsibility to ensure that the information you provide is accurate and not misleading. You cannot create an account or username and password using the names and information of another person or using words that are the trademarks or the property of another party, or vulgar, obscene or in any other way inappropriate.
2.5 Should you be in breach of these terms we reserve the right to terminate your account and access to all its content on immediate notice without liability. A refund will not be applicable to you should termination arise in accordance with this clause 2.5.
3. Product and Service Pricing
3.1 We reserve the right to alter all content, products, services and pricing content and
without notice to you.
4. Your Order
4.1 When you place an order you will automatically receive a confirmation from us to confirm your order. Your order constitutes an offer made to us to purchase a product or service.
4.2 Your offer is only accepted by us once we have emailed you to confirm the creation of your account and your username and password details and the product or service has been provided to you.
4.3 Product or service items not included within your account email are not included in the order and contract between you and us.
4.4 We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.
4.5 If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account.
5. 1 If you require an invoice to be raised for a single annual subscription a 10% admin fee will be applied.
5.2 If you require an invoice to be raised for less than 10 annual subscriptions an admin fee will be applied (10% of a single annual subscription).
5.3 Payments via invoice must have the invoice number as a reference on the bank transfer or cheque or delays in activating the subscriptions will occur.
6. Subscription Period and Free Trials
6.1 After satisfactory payment of the subscription fees and supply by us of your username and password, you will have access to the website and the products and services provided by the website for your subscription period.
6.2 To avoid any disruption of service, your subscription will automatically renew at the
end of each subscription period.
6.3 For annual subscriptions, you will automatically receive an email notification before your subscription expires, notifying you or your forthcoming renewal and providing details of how to cancel your renewal.
6.4 Where we are unable to renew your subscription, we will automatically suspend or downgrade your account and notify you via email and allow you to update your payment details or take out a new subscription. Please note in this instance you may lose any previous discount or special offer related to your previous subscription.
6.5 Where you are offered a free trial period you will receive an email notification before your free period is due to end and convert into a paid subscription. Please note this does not apply where you are merely offered a discounted or offer period, paid for subscription at a reduced rate that subsequently converts to a subscription at one of our full standard subscription rates.
7. Cancellation Rights and Refunds
7.1 You can cancel your subscription at any time and the subscription will not renew at
the expiry of your subscription.
7.2 And you can change your subscription at any time from monthly to annual or vice versa.
7.3 To cancel your individual subscription, login to your account and go to Dashboard > Billing > click Change Plan to unsubscribe and remove your card details.
7.4 To cancel a group subscription email email@example.com to arrange cancellation of subscription.
7.5 We cannot offer partial refunds on early termination requests.
8.1 We take all reasonable steps to ensure the website is available and functioning fully at all times, However, we do not accept any responsibility for “down time” or poor performance of our fileservers or where the website or any associated service is unavailable for any reason, whether within or outside our direct control.
9. Customer Complaints
9.1 We endeavour to respond to all customer complaints or queries within three working days. Should you wish to make a complaint please contact us using the following email address, firstname.lastname@example.org
11.1 We grant you a limited licence to access the content, information and services contained within our website.
11.2 This licence does not allow you to make our website available via an intranet. However, if you wish to have this available on your intranet please contact email@example.com please note further charges may apply.
11.3 Our website and its content shall not be copied, edited, modified, downloaded or otherwise manipulated without our express prior written permission.
11.4 Our website shall not be placed within the frame set of another website without our express prior written permission which will not be unreasonably withheld.
12.1 The entire communication with us is electronic. Every time you send us an email or visit our website you are going to be communicating with us. You agree that all notices, disclosures, agreements and other communications we provide to you electronically meet the minimum legal requirements regarding such communications.
13. Entire Terms and Conditions
13.1 These terms set out the entire agreement and understanding between you and us. We reserve the right to change these Terms at any time, without giving notice and without getting your prior consent.
14.1 Any dispute related in any way to your visit to our website or regarding any products (including subscriptions) you purchase from us shall at first be attempted to be resolved between you and us, however if this is not possible the dispute shall be referred to the courts noted in clause 14 below, who will act as arbitrators.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
